2952 Victory Blvd. Pump Corp.

HISTORY

2952 Victory Blvd Pump Corp. (2952 VBPC) took on the ownership and responsibility of the communities waste water management facility in October 2003. Since our ownership the following has occurred:

  • Initial billing of station residents in 2003 and 2004

  • Court order issued in 2004 to stop further billing and collections until court order complied with.

  • From 2005 - 2007 2952 VBPC continued capital improvements of pumping station in order to secure the stations longevity. 

  • From 2008 - 2013 2952 VBPC continued to improve the station's mechanical, electrical, plumbing and security system in order to comply with all NYC Building Department regulations. 

  • In May 2009 2952 VBPC passed all requirements and final inspection from the NYC Health Department.

  • In April 2013, NYC Health Department re-confirmed all requirements are complied with as per the request of the NYC Building Department prior to issuing the Certificate of Occupancy.

  • In May 2013, 2952 VBPC received confirmation from NYC Water Board Legal Department that our billing rates were not part of their jurisdiction. 

  • In October 2013, 2952 VBPC property location was issued a final Certificate of Occupancy from NYC Building Department and completed the requirements per the 2004 court order.

  • October 2014 NYC Parks Department and Verizon are invoiced for all back monies due from 2013. 

  • January 2015 NYC Parks Department begins to investigate and thoroughly review the billing rates and documentation provided by 2952 VBPC.

  • May 2015 , NYC Parks Department accepts the billing rates and contract as fair and equitable and remits payment. 

  • June 2015 Verizon challenges Pump Station commercial billing rates and the legal rights of 2952 VBPC to invoice based on state regulations. 

  • June 2015 based on the new legal developments, 2952 VBPC did not invoice any of the other local businesses or residents until this legal matter was settled accordingly. 

  • July 2016 Verizon, after careful investigation of our billing rates, and understanding that we are in compliance with all NYS and NYC regulations, settles with 2952 VBPC and begins making monthly payments for services.

  • In September 2016, 2952 VBPC  requires NYC through the filing of an Article 78 to recognize the Pump Station as a NYC Sewage Works Corporation. This would effectively put 2952 VBPC under the jurisdiction and responsibility of NYC in the unlikely event that the Pump Station was abandoned as it previously was abandoned in 1999. 

  • In June 2017, NYC Parks Department and the City Council Legal Department settled with 2952 VBPC effectively confirming that we are not a sewage works corporation and we are not under the jurisdiction of either NYC or NYS. The final settlement also confirmed that NYC is responsible for all back payments from 2013 and that 2952 VBPC is a privately owned pumping station whose rates have been approved and accepted by NYC. 

  • August 2017, 2952 VBPC begins invoicing residents and businesses connected to the Pump Station accordingly.
